Spanish or European family member

If you are a family member of an European Union citizen, you or your family members can obtain residence permit right away.​

 

This residence permit is called the familiar de comunitario and it comes with a working permit. ​

 

This permit is very useful for example if you have children abroad or for foreigners who are already in Spain and don't have papers at the moment but have a bf or gf who are spanish or european because that gives them the opportunity to apply for residence permit right away without waiting for arraigo social.

WHO IS CONSIDERED AS A FAMILY MEMBER?

 

  • Husband/Wife

  • Registered partner / Unregistered partner similar to a husband/wife (Pareja de hecho)

  • Children under 21 years old or Children 21 and older (proving that they depend on you)

  • Parents (must be proven that they depend on you)

  • Any other family member that depends financially

  • Any other members who suffer a disability or need medical care

WHEN CAN I START THE PROCESS?

 

Anytime, no need a minimum time of living in Spain.

 

MAIN REQUIREMENTS

 

  • Being in a family member of EU citizen. That is the main requirement. If you are already married then you just need to get your marriage certificate and start the process. If you are not married yet you can consider first getting married or you can also consider becoming pareja de hecho. The pareja de hecho is a simpler process in which you register yourself as official partner and the effects for the foreign office is similar to being married. Then after you are pareja de hecho you can apply for residence permit.

  • Being in Spain. The family member of the EU citizen must be already in Spain. If the person is abroad, the first thing is requesting a visa to come to Spain.

  • Economical means. The UE member must have a job in Spain or evidences of savings/income to proof that can take care of applicant needs.

 

WHERE THE PROCESS STARTS?

 

The process starts in Spain so if the foreigner is not in Spain the first thing is obtaining a visa to fly to Spain and then apply to obtain the comunitario.

 

WHAT DOCUMENTS DO I NEED TO START THE PROCESS?

 

  • Full passports (all pages).

  • NIE/DNI of the EU member.

  • Proof of the family relation (marriage certificate, birth certificate, pareja de hecho, proof of relationship. The documents, if from abroad, must be apostilled and translated (max 6 months old). The documents from Spain max 3 months old.

  • Proof of economical means. Work contract of the EU citizen, payslip, bank statement.

  • Volante de convivencia max 3 months old.

PRICE

 

The price depends on the province that you live, the time is takes, if we need to present more than one time the documents etc.. but generally the fee is betwen 200 -300€ paid once the application is aproved.

 

The fee doesn’t include the process tax, fly ticket fee, visa application fee, translation fees.
