The general idea for petition is to bring your first degree family members.

 

We receive many times this question regarding the petition of siblings

 

The answer will depend on your nationality and on the situation on your sibling.

If you are a FOREIGNER…

If you are foreigner with residence permit in Spain (NIE), as of the moment unfortunately there is not a way to petition a sibling to Spain.

 

The law might change this year or the following but for now petition is only for first degree family members (husband, wife, children, parents etc..). For the guide of petition of first degree family members click here.

If your sibling has the parents in Spain it is possible to do oferta de trabajo by finding and employer in Spain.

 

Also is not possible to find and employer willing to sign a contract for your sibling.

 

So are there not any options for siblings to come to Spain?.

 

Yes there are other possible ways to him/her to come but it will not be related to you. They should apply to be a student, non working permit (NLV), highly skilled worker, necessary worker, teaching assistant etc...   

 

If you are SPANISH…

 

If you are Spanish it is possible to petition your siblings so that is already good news however there are certain requirements. The sibling should meet the following conditions:

 

• Is very dependent of the Spanish citizen to be able to live and cover his daily expenses. In the country of origin can’t work and only lives with the money that the Spanish citizen sends.

 

• Is living with the Spanish citizen abroad for more than 24 months (is part of the family unit) and now the Spanish and the sibling is moving to Spain.

 

• Has a disability or bad health condition that doesn't allow him/her to take care of himself/herself and only the Spanish citizen can take care of.

The process can be done any time as soon as you obtain your spanish nationality.

 

In our experience...

 

Petition of siblings if you are Spanish is possible and sometimes successful, however is not the general rule and not as simple as petitioning your husband if you are spanish or children for example in which there are not requirements and it's always accepted.

 

For siblings, only the case if you are spanish and if really have strong evidences of the conditions above will have good chances to get the application accepted.

 

It is always possible to present the application but if your sibling is in a normal situation (works, is healthy, is not disable, is not living with you) and the situation is not well studied and analyzed, the general result is that it will be denied so we should prepare the case very well before presenting the documents to have the best chances to be approved and you be again next to your beloved one in Spain.​​​​​​​​​
