PETITION. Family Reunion

WHEN CAN I START THE PETITION?

 

You can start the petition when have had legal residence permit already for 1 year. 

​

That means that if you do not have papers yet, first you will need to get residence permit and then after 1 year of legal residence (when you have renewed your first card) you can start the petition of your family members to bring them to Spain.

​

For petitioning of parents you will need to become larga duracion (5 years legally in Spain) before you can petition them. Here is the information about the larga duración.

​

If you came to Spain as a petioned or if you came with a job offer or as another type of permit (NLV, Highly qualified, etc..) contact us so we study your situation and check the requirements in your case as it might be different process.

WHO CAN I PETITION?

​

It is important that not all family members can be petitioned. Only first degree family members are entitled.

 

  • Husband/Wife

  • Pareja de hecho (partner in law)

  • Partner similar to a husband/wife (in some cases, for example if you have children together, lived together before etc..)

  • Children from your or from your partner under 18 over or 18 in exceptional cases (disable)

  • Parents 65 and over or under 65 of you or your parner in exceptional cases (really in need)

For children that are nearly 18 years old the process should start asap once you are nearly 1 year in other to be able to present the documents before they become 18.

DO I NEED TO HAVE A HOUSE TO PETITION MY FAMILY MEMBERS?

​

Yes, having a house (rent or own) is necessary to be able to present the application for family petition. The reason is that the government wants to know that your family member will have a place to stay when comes to Spain. 

​

Important:

​​

  • The house needs to be really a house (a local for example is not valid)

  • The process can start as soon as you rent the house (no need minimum time living there)

  • It is ok that other members live in the house too but that might diminish the person that you can petition.

  • It is ok that other members are join in your house contract but that might diminish the number of persons that you can petition.

DO I NEED TO HAVE A JOB TO PETITION MY FAMILY MEMBERS?

​

Yes, you need to have a job as a normal rule (it is also ok if you have savings to cover your and your family expenses). 

​

The kind of job that you need can be in a house or in a company. The important that you have a stable job and stable income. 

​

It can also be possible to apply with more than one contract.

​

HOW MANY MEMBERS I CAN PETITION AT ONCE?

​

It is possible to petition more than one person at the same time however the answer depends on the size of your house and on your salary.

​

If you have a house that it has 2-3 rooms and you have salary above the minimum salary it should be ok to petition. 

 

We have succeed to petition a husband/wife and 2-3 children at one time.  â€‹

WHAT DOCUMENTS DO I NEED TO START THE PROCESS?

 

Step 1: The process start by presenting an application to visit your house to obtain an informe de vivienda that will state that your house is ok to bring a family member.

 

For that application we need:

 

  • House Contract. It is ok if you just moved in or if other people are in the contract too.

  • Volante de convivencia (Ayuntamiento). It shows all the people living in the house.

  • NIE or resguardo of renewal

  • Full passport of you and first page of your petitioned passport

  • Last rent receipt. If you just moved in proof of down payment

  • Last utilities receipt (water, electricity etc..) It is ok if they are not in your name

 

Step 2: Once we obtain your informe de vivienda, the next step is presenting the documents in the foreign office and for that we need the followind documents:

​

  • Full passport of your family member.

  • Birth/marriage certificate + Apostille (translation we can do)

  • For children, affidavit of consent of the father + apostille (translation we can do)

  • Nóminas 6 latest

  • Nóminas of all the other people empadron in your house

  • Money remittance

  • Criminal records + Apostille + Translation

TIME

 

​The timing varies depending on the province that of your residence and on the speed of the foreign office in that moment but generally it can take between 6-9 months aproximatelly. 

​

The best thing to do to make it the fasts possible is that we study the documents prior to the presentation and that we have all ready for the second step.

  • Bring printed all the documents to our office

 

PRICE 

 

Our price policy is that you make a small payment when we start the renewal and we present your documents and your final payment comes once we call you and we give you the good news that is already favorable (approved) and your family member can come to Spain.  

​

We are sure it will be approved so we do not mind waiting for the aproval to get our payment!

​

Our fee varies depending on the province, what person are you petitioning, when you apply etc..that so you can contact us and we will inform you.

 

Our fees doesn’t include the fly ticket fee, visa application fee, translation fees.
