STUDENT TO WORKING PERMIT

​​​Once your student visa is terminating, and if you have finished the course that you had apply to obtain your student visa, you have 3 options.

​

  1. Extend your studies by continuing studying or choosing another course.

  2. Convert our student visa into a working permit that will allow you to stay in Spain legally while you are working.

  3. Ask for job search permit if you can’t find a job and you will not continue studying.

​

If you find a job offer (someone willing to hire you), then you can choose option 2 and you can change your student visa into a normal working residence permit and we will be glad to assist you.

 

Requirements to convert to working permit:

​

  • Finish the studies (or be nearly) that you applied to obtain your student visa and obtain the diploma or certificate.

  • Have a job offer of 40 hours or less that cover at least minimum salary. In 2024 is 15.876€ per year. That means that you can have 30 hours work contract but the salary will still be 15.876€ yearly.

When does the conversion of student permit to work application permit starts?

​

It starts 60 days before your card expires up to 90 days of expiraton. The application timming is strick so the application can't be presented outside of this dates.

​

It won't affect the result if you apply before your card expires or after as long as it is within the time frame so here is no problem to present the application after your card has expired. If you can not find a job yet don't worry and keep looking.

Documents needed:

​

For the applicant

​

  • Full Passport (all pages)

  • NIE

  • School diploma/certificate

  • Work contract offer from the company

  • Criminal records if your studies were shorter than 6 months

  • Medical certificate if your studies were shorter than 6 months

​

As opposite to the student visa, for the working visa you will no need to have savings and you will no need to have an private insurance since you will have your own income with the work offer and that also includes coverage of public health insurance.

 

For the company

​

  • DNI or NIE of the owner/administrator

  • Poderes del administrador (if a company)

  • Declaración de IVA or Declaración de Impuesto Sociedades (tax documents)

  • Vida laboral de la empresa

  • Certificado de no deudas con la Seguridad Social

  • Certificado de no deudas con Hacienda

For the employer (if the employer is not a company)

​

  • DNI or NIE of the owner/administrator

  • Declaración de IVA or Declaración de IRPF (tax declaration)

  • Certificado de no deudas con la Seguridad Social.

  • Certificado de no deudas con Hacienda

For the employer (for house work)

​

  • DNI or NIE of the employer

  • Volante de convivencia (padron colectivo of your employer that shows all the people living in this house)

  • Declaración of last IRPF (tax declaration)

  • Certificado de no deudas con la Seguridad Social.

  • Certificado de no deudas con Hacienda

​

What work contract do I need?

​

You can present any job offer for any kind of job. Doesn’t need to be related to your studies and the only requirement is that the job offer needs to covert at least the minimum salary of 15.876€.

​

It can also be hous work.

​

Can I have more than one contract?

​

Unfortunatelly for this permit only one contract is allowed to present with the application.

​

What happens if my 90 days after my card expired are near and I didnt find a job offer?

​

No problem. The fact that you presented the application on time means that your student permit is extended until you get the result of the working permit so you will be in legal situation in Spain even your card is expired.

​

Once I get the result what permit will you get?

​

You will get a 1 year residence and working permit that can be renewed and which card also counts for your time for Spanish nationality application.

 

Can I work while my permit is on process?

​

If your permit as student allowed you to work while you were studying (in your TIE card it says “Autoriza a trabajar” then you can continue working until you ge the result.

 

If your TIE card it says “No Autoriza a Trabajar” then you can’t work until you get the result.

 

How long is the process?

​

Depends on the province that you live but generally the expected time is 3-6 month.

 

What happens if my student permit expires and I didn’t get the result yet for my working permit?

​

No problem. The fact that you presented the application on time means that your student permit is extended until you get the result of the working permit so you will be in legal situation in Spain even your card is expired.

​

Can you change job after you get the approval?

​

Yes you can change job to any other company. You are not tied to the company that changed your student visa to working permit.

 

Are there any government/police taxes in this process?

​

Yes, there are 3 taxes. For you the taxes fee is around 40€ and for your employer around 200€.

 

How much is the process?

​

100€ when presenting the documents and 250€ when the application is approved. VAT included.

Bringing your family members​

​

Good news! Your family members can join you in Spain because this permit includes the possibility of bringing your family members to Spain with the process called petition or reagrupacion familiar. That means that wou will be able to petition your children, spose and parents. Click here for more information.

Renewing the working permit​

​

The permit that you will obtain is a normal working permit so that means that the only thing that you will need to provide at the end of this first permit is that you have worked at least 3 months and that you have a job on the moment of renewal.

​

Applying for Spanish nationality with this permit

​

When you are studying, that visa is not considered residence yet so that time doesn't count for your spanish nationality minimum time of residence. However, once the permit is granted your residence time will start counting toward your minimum time for spanish nationality. Click here for more information about spanish nationality.
